Damage to teeth
The most common causes of Damage to teeth are either injuries sustained as the result of criminal injury, playing sports, being involved in a vehicle accident or as a result of dental malpractice.
If, during an assault or violent crime, you suffer damage to your teeth you are entitled to compensation from he Criminal Injuries Compensation Authority (CICA). The standard CICA payout for the loss of a tooth is £1500. To be entitled to a payout from CICA you must report the attack to the police within a reasonable time and help them fully with their enquiries. Proceedings must also be started within two years of the assault.
If you damaged your teeth while playing sports as a result of inadequate supervision (eg refereeing) or instructions, dangerous playing surfaces or faulty equipment you will be entitled to compensation. Sports participants are responsible for their opponents safety and teeth damaged as the result of dangerous challenges or play should be compensated for. Luckily sportsmen at almost every level and sporting venues are covered by insurance.
If you are involved in a motor vehicle accident and suffer damage to your teet you can claim compensation from the insurance company of the driver judged to have caused the accident. If they were uninsured you can claim from the Motor Insurers Bureau.
Most dental negligence claims are fairly clear cut. Dentists have to provide compensation if they provide treatment which falls below a minimum standard of care and skill which would be reasonably acceptable to a qualified dentist. Luckily all dentists have to be insured, most are covered by insurance companies and those that aren't are covered by the NHS's compensation scheme. Dental malpractice claims are usually far more successful and clear cut than other Medical Negligence claims. This is because very little can go wrong during dental treatment, and unexpected injuries are usually a result of inattention or carelessness rather than a result of unforeseeable conditions or external circumstances.
