SOLICITORS HELPLINE 0845 644 6327

In 1930 the British government made it mandatory for the drivers of road vehicles to carry motor insurance to indemnify the driver against third party compensation claims for injury and damage to property. If a driver is at fault for an accident then their insurance company will pay the third party for their losses. Even if a negligent driver is uninsured or untraced, you are not without legal recourse - the Motor Insurers Bureau (MIB) will make sure that the injured party is compensated. When an accident is caused by a hit & run driver or a driver without insurance you can make an untraced or uninsured driver claim to the Motor Insurers Bureau (MIB). We can assist you throughout the MIB claims process and we can help you understand the strict qualification guidelines imposed by the MIB.

Complex Procedural Rules

The Motor Insurance Bureau is a private limited company set up by Government and funded through a levy assessed on all motor insurance companies. The MIB is tasked with protecting motor accident victims against financial loss from untraced or uninsured drivers. Compensation claims are reviewed according to complex guidelines that differ from the adjudication of normal accident claims involving insured drivers. Procedural mistakes by inexperienced solicitors lead to numerous of allegations of professional negligence every year by clients who have lost their right to receive an award of compensation.

MIB Untraced & Uninsured

Most claims for compensation to MIB fall under one of two categories :-

  1. Uninsured Driver

If the negligent driver in a motor accident is uninsured, the MIB will adjudicate the claim to fully compensate the victim for all damages and legal costs – subject to a nominal excess deduction – even if the uninsured motorist is unable to personally pay those costs. The MIB will fully compensate the victim and will thereafter pursue recovery from the uninsured motorist. Our solicitors will represent your claim against an uninsured motorist before the MIB on a no win no fee basis and full compensation will be paid without deduction.

  2. Untraced Driver

If the negligent driver is an untraced or unidentified hit & run criminal, the MIB is authorized to compensate victims for personal injuries and certain other losses. The MIB guidelines allow partial payment of the claimant’s legal costs, the balance of which will be deducted from the award on terms agreed in advance.
